In the event a family member becomes unable to make personal and financial decisions due to incapacity, and he or she has not executed a durable power of attorney, we can commence a guardianship proceeding. These proceedings are brought under Article 81 of the Mental Hygiene Law, and may be either contested or uncontested, with the goal of having a trusted family member, advisor or friend appointed as guardian for the incapacitated individual. A guardianship can be created for a person, his or her estate, or both. Guardianship of a person requires the guardian to make important decisions surrounding the care and support of an elderly or incapacitated individual, who may not be able to make decisions on their own. In this situation, the guardian may be required to consent and monitor medical treatment, make arrangements for professional services, monitor living conditions, and make end-of-life decisions for the individual. The guardian is also expected to make decisions regarding physical and financial needs. The guardianship will continue until the person passes away or the court rules that a guardianship is no longer necessary. I want to talk about a trendy thing called a Living Will. Kind of a funny name because you think of a will, a will only applies when you die. But a living will is one that says I am still alive. I may be on life support and I need someone to make decisions on when to pull the plug. Essentially, that’s what a living will is. You express your preference and your desire to your agent and to your doctors, and your hospital that says don’t keep me on life support. There are some standard provisions that we put into every living will. So that is what a living will is. It’s not to pass on any assets. It’s not to make any other major decisions in your life. It just expresses your intention that you don’t want to be kept on life support when there really isn’t a chance that you are going to come out of it. So that’s what it allows. If you don’t have that, as we have seen in the news, of people who are kept alive for a long time and everyone knows that was against their wishes, but they didn’t write it down in a living will.
